Agreed he's sitting on the one seat but he is also blocking the aisle so wouldn't the airline be in beach of H&S since he's blocking the escape route. Unless he was taking multiple seats like the empty ones behind and he was just talking to his mate while having a little stand up or something similar. But yeah i would think he should have two seats and not block the aisle and even that's assuming he can get out in the allotted time if escape was required.
